Divorce Law and Children and Client Support Considerations

Divorce cases are some of the most emotionally wrenching cases for the individuals and families involved. They can become hostile. Children's interests can be forgotten. Our family law attorney will not forget the children and what is in their best interests. Divorce often creates such a confused environment that is easy to overlook future considerations for clients themselves, as well as, their children.

For instance, it is important to consider whether or not the vehicle you are currently driving will last through the divorce or if it will die shortly thereafter. Children's college funds should be considered. Do you want to set up joint or separate accounts now for that purpose? Will you need alimony and if so, for how long and for what purpose? Many questions regarding care of the child and your ability to support yourself must be considered.

When issues of child support arise and the parent responsible for paying child support does not, then that parent's wages may be garnished. A parent who does not pay child support may face civil and criminal penalties. It is parents' constitutional right and responsibility to provide for their child.

Domestic Violence and Children

Domestic assault and domestic battery have very negative family consequences. When a child is present during the domestic disturbance, child protective services becomes involved. Generally, the child will removed from their home and placed in a foster home. This occurs more often than it should.

Domestic violence is prosecuted excessively in California. Each county is eligible to receive a grant based the number of convictions for domestic violence. The other problem with domestic violence is that police are required to arrest an involved party when they arrive at the scene of the incident. This is true even when they are called there by neighbors, when the parties were fighting but did not expect any outside intervention.

There are numerous cases where parties were fighting but not physically. Their yelling at one another or hitting a wall incited a neighbor to place a call. The couple then suffers the consequences, one of them going to jail and the possibility of losing their child or children to foster homes.

When domestic violence or child neglect and abuse occurs, it is very important for a partner or spouse to obtain a restraining order against the domestic assailant and to file charges with the police. But the charges should be founded in reality and not mere allegations. The system prosecutes quickly without thinking about what is best for the children involved or for the family.
