You may need to post a bond to gain release for yourself or a loved one if jailed for DUI in California. In order to “bail out”, you need to either have the funds to post the bond as set by the court, or obtain a reputable bail bond agency to do it- and this choice is an important one.
There are a large number of bail bond agencies in California, so you should interview bail bondsmen carefully. Some questions you should ask include:
Does the bail bond agency service the jail you, your friend or relative’s in?
How quickly can they be there?
Do they offer payment plans or will they require collateral? How will they return your bond to you?
It’s key that you know what to do and what’s expected of you before you contract the services of a bail bond company.
Once a bail bond is posted, release takes between 5 minutes and 12 hours, depending on the size of the jail and the experience of your bondsman. The bail bond you obtained is valid from time of release until the case is resolved.
If, however, any court date is missed by the defendant, whomever posted the bail is subject to immediately pay the entire amount of the bond. The person responsible for the bond may also have to pay any expenses the bail bond company incurs getting their bail bond “exonerated” by the court (“exonerated” is the legal term for the court releasing bail money back to the bondsman). Have your bail bondsman explain this process to you fully.
Once the case is over, the court will exonerate the bail bond regardless of the outcome. This means that your obligation to the bail bond company is also over. When the case is resolved, call the bail company immediately and let them know. This will cause the bail bond agency to release any collateral you might have used to secure the bail bond.
